Terms of Service

1. Eligibility

You must be at least 18 years old, or have your parent or legal guardian's consent, to use the Service. You must be capable of entering into a binding contract under Thai law.

2. Account & security

You may sign in with Google or with a one-time email code. You are responsible for keeping your account credentials secure and for all activity under your account. Each account is for one person — you must not share login credentials.

You must provide accurate information when registering and keep it up to date. We may suspend or terminate accounts that contain false or misleading information.

3. Plans, trial & billing

We currently offer three plans: Free, Pro, and Business. Detailed pricing and feature comparisons are listed on our pricing page.

During the public beta, all features are available free of charge until 16 June 2026 (the "Trial Period"). At the end of the Trial Period you must select a plan to keep using paid features; sites left without a plan will continue on Free with reduced features.

Paid plans renew automatically on an annual cycle unless cancelled before the renewal date. You authorize us (and our payment processors) to charge your payment method on each renewal.

Plan upgrades take effect immediately and are prorated. Plan downgrades take effect at the end of the current billing period. Fees are non-refundable except where required by law. Taxes are your responsibility unless we are required to collect them.

4. Your content & responsibility under Thai law

You retain ownership of all content you upload, create, or publish through the Service ("Your Content"). You grant SeedWebs a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and back up Your Content solely as needed to operate and improve the Service.

When you create a site you must designate a Legal Responsible Person, including their full name and phone number. The Legal Responsible Person is the individual responsible under Thai law — including the Computer Crime Act B.E. 2550 and the Personal Data Protection Act B.E. 2562 (PDPA) — for content published on that site.

You represent that all information about the Legal Responsible Person is accurate. False or misleading information may result in immediate termination of the relevant site or account, without refund.

You are solely responsible for Your Content, for obtaining all necessary rights and permissions, and for complying with applicable laws — including, where relevant, copyright, trademark, defamation, consumer protection, advertising, e-commerce, and personal data laws.

5. Prohibited use

You agree not to use the Service to:

• publish, transmit, or store content that is illegal under Thai law, including content that infringes the Computer Crime Act, defames others, infringes intellectual property, or violates lèse-majesté laws;
• operate gambling, adult, or other regulated content without the licences and age-gating required by law;
• distribute malware, phishing material, spam, or unsolicited bulk email;
• attempt to gain unauthorized access to the Service, scrape or stress-test the platform, or interfere with other tenants;
• white-label the Service as your own product, or build a competing CMS on top of it, without written permission;
• impersonate any person or organisation, or misrepresent your affiliation.

Agencies, freelancers, and developers are welcome to build, manage, or maintain sites on SeedWebs on behalf of clients — that is permitted use of the Service. The restriction above applies only to reselling SeedWebs itself as your own product.

We may remove content, suspend sites, or terminate accounts that breach this section, with or without prior notice depending on the severity.

6. AI features (bring your own key)

Some features (AI writing, translation, chat widget) require you to provide your own API key from a third-party AI provider (e.g. Google Gemini). You are responsible for:

• complying with the AI provider's terms;
• paying any usage fees billed directly by the AI provider;
• the accuracy, legality, and appropriateness of any AI-generated content you publish.

We store your API key only as needed to operate these features within your tenant. You may remove your key at any time from Settings.

7. Custom domains

Custom domains are available on Pro and Business plans. You must own or have authority to use the domain you connect. By connecting a custom domain, you authorize Cloudflare to provision and renew an SSL certificate on your behalf.

If your plan no longer supports custom domains, the domain may be suspended until the plan is reactivated. We may disconnect domains used in breach of these Terms.

8. E-commerce, payments & members (Business)

The Business plan provides e-commerce, members, orders, and bookings features.

Payments from your customers are processed through third-party providers — currently Stripe and PayPal. Your use of these providers is subject to their own terms. You are responsible for:

• pricing, taxes, invoices, refunds, and customer service for orders on your site;
• complying with PDPA and other data-protection laws when collecting customer or member information;
• ensuring your offerings comply with applicable consumer-protection and e-commerce laws.

We are not a party to transactions between you and your customers, and we do not act as a merchant of record on your behalf.

9. Beta period

During the beta, the Service is provided as-is and may change, contain bugs, or experience downtime. We may reset or migrate beta data on reasonable notice. We do not guarantee that beta features will continue to be available, or available at the same price, after launch.

Beta users who continue on a paid plan after launch will receive a 30% lifetime discount on Pro or Business renewals as long as the plan remains active without lapsing.

10. Inactivity & data retention

Free accounts inactive for 12 or more consecutive months may be archived. We will email the account owner before archiving. Archived accounts are deleted 30 days after the warning email if no activity resumes.

We retain automatic backups of your tenant data for 30 days. Manual snapshots and longer retention may be available depending on your plan.

11. Suspension & termination

We may suspend or terminate your account or any site if:

• you breach these Terms;
• payment fails and is not resolved within a reasonable grace period;
• we receive a credible legal request, court order, or law-enforcement demand;
• continued provision would expose us, you, or other users to legal or security risk.

You may cancel your account at any time from Settings. Pro and Business plans include data export so you can download Your Content before deletion. Free-plan content is deleted on cancellation without export.

After termination, we may retain limited data as required by law (e.g. accounting records) and as needed to enforce these Terms or resolve disputes.

12. Intellectual property

SeedWebs — including the platform, source code, default theme, documentation, logos, and trademarks — is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

You retain ownership of themes you create. You may not reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent that applicable law permits.

If you submit feedback or suggestions, you grant us a non-exclusive, royalty-free licence to use them without obligation.

13. Service availability

We host the Service on Cloudflare's global edge network and aim for high availability. We do not guarantee any specific uptime on the Free plan. Pro and Business plans receive priority support.

We may schedule maintenance windows or apply security updates without notice. We are not liable for outages caused by third-party providers (including Cloudflare, Stripe, PayPal, or AI providers), force majeure, or events beyond our reasonable control.

14. Privacy

Our handling of personal data is described in our Privacy Policy. We comply with the Personal Data Protection Act B.E. 2562 (PDPA) and act as a data processor for the personal data you and your visitors store on the Service. You act as the data controller for the personal data on your sites.

15. Disclaimers & limitation of liability

The Service is provided as-is and as-available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law:

• our total aggregate liability under these Terms is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim;
• we are not liable for indirect, incidental, special, consequential, or punitive damages, lost revenue, lost profits, lost data beyond our backup retention period, or business interruption.

Nothing in these Terms excludes liability that cannot be excluded under Thai law.

16. Indemnification

You agree to indemnify and hold harmless SeedWebs, its officers, employees, and contractors from any claim, loss, or expense (including reasonable legal fees) arising from:

• Your Content;
• your use of the Service in breach of these Terms or applicable law;
• any dispute between you and your customers, members, or visitors.

17. Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 30 days' notice by email and/or in-product notice. Continued use of the Service after the effective date means you accept the updated Terms. If you do not accept, please stop using the Service before the effective date.

18. Governing law & disputes

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or related to these Terms or the Service will be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand.

If a translation of these Terms is provided in another language, the Thai-language version controls in the event of any conflict or inconsistency.
